Defense attorney for suspended DA Mark Jones removed by judge

COLUMBUS, Ga. (WTVM) - A judge has removed Attorney Chris Breault from suspended District Attorney Mark Jones’ Columbus Civic Center case.

The decision was based on Breault being a witness for the state of Georgia in the case. The judge made the decision to remove Breault Friday and the order was released Monday morning.

Attorney Chris Breault released a statement on the proceedings saying:

“It is clear that Judge Lumsden is prejudiced against DA Mark Jones and determined to deprive him of a fair trial. She is very biased in favor of Law Enforcement—her husband is a long-time member of the Georgia State Patrol. This afternoon we filed a Motion to Disqualify Unfair and Biased Judge, and expect her to be removed from the case”

The judge says it’s a conflict of interest for Breault to represent Mark Jones in the bribery case since Breault is a material witness for the state.

According to the order, the judge is allowing the state to admit messages between Breault and the potential witness, Andrew Lloyd, into evidence against the suspended DA.

Other pre-trial motions include, preventing the defense from bringing up Jones’ suspension in court and calling witnesses to the stand in hopes of preventing ‘self serving testimony’ on Jones’ behalf.

Trial is scheduled to start November 8.

Separate from this case, the charges against Jones in the destruction of property case where he was accused to damaging property at the Columbus Civic Center, have been dropped by the state.
